Employees whose employment contract is terminated without valid cause may pursue legal remedies seeking reinstatement, provided certain conditions are met.

To be eligible to request reinstatement, statutory conditions must be jointly satisfied, such as the employee having a certain length of service and the workplace employing a certain number of workers. Whether these conditions are met in a specific case must be assessed individually for each file.

The time limit for filing a reinstatement lawsuit is quite short; therefore, it is important to seek legal advice without delay from the date the termination notice is served.

The process begins with a mandatory mediation application; if no agreement is reached in mediation, litigation may follow. At every stage of the process, correctly observing deadlines and procedural rules is critical to avoiding loss of rights.
