Jewelry Given at the Wedding (New Precedent)

Court: Court of Cassation of Türkiye
Chamber: 2nd Civil Chamber
Case No.: 2023/5704 E.
Decision No.: 2024/2402 K.
Decision Date: 04.04.2024

The 2nd Civil Chamber of the Court of Cassation changed its previous case law, ruling that jewelry and other items of economic value given to spouses at a wedding are, as a rule, deemed to belong to the person to whom they were given, unless there is an agreement to the contrary or a local custom, but that items specific to the opposite sex are deemed to have been given to that sex. In the case at hand, since the husband could not prove that he had returned to the wife the jewelry found to be in his possession, the decision dismissing the claim for return of the jewelry was reversed.
