The 2nd Civil Chamber of the Court of Cassation ruled that, in addition to the husband's insulting conduct, the wife's making unwarranted economic demands on her husband for both herself and her family, neglecting marital duties, and displaying trust-undermining behavior meant that the parties should be deemed equally at fault for the events leading to the divorce. Consequently, awarding pecuniary and non-pecuniary compensation (TMK m.174/1-2) in favor of the equally at-fault wife was held to be grounds for reversal.
