Limitation Period for Actions Concerning Damages Caused by a Defective Product

The 4th Civil Chamber of the Court of Cassation ruled that, under Article 4 of Law No. 4077, claims for damages caused by a defective product (a vehicle whose airbags failed to deploy due to a manufacturing defect) are subject to a three-year limitation period running not from delivery of the product but from the event that caused the damage. Taking into account that three years had not elapsed between the date of the accident and the date the action was filed, the decision dismissing the case on grounds of limitation was reversed.
