The 2nd Civil Chamber of the Court of Cassation ruled that, in actions filed on the basis of specific grounds for divorce such as attempted murder, severe cruelty or degrading conduct (TMK m.162), or the commission of a crime and leading a dishonorable life (TMK m.163), it must first be examined whether these specific grounds have actually occurred; if the specific ground has not been established, the evidence must then be assessed within the framework of the general ground for divorce (TMK m.166/1-2). A judgment rendered without following this order of examination was reversed on this basis.
